I am getting ready to file I-485. Is it mandatory to apply I-131(EAD) and I-765 (AP)? I got 3yr extension which is valid till 2009 and i am not planning to use EAD anytime soon.
What if i just apply for I-485 in the beginning and apply for EAD or AP whenever there's need? Please let me know.

You can apply EAD/AP whenever you want to, provided you have filed I485. It need not be exactly at the time the I485 is filed.

I agree with focusing on the Logfren bills, but the flower campaign might not work. Last year it was a combination of pressure on the lawmakers, USCIS and DOS by IV, AILA and a other groups. the flower campaign highlighted the issue to the public and gave us wide exposure...last years fiasco did not require a law change. In our case the clear cut issue is to make recapture happen. The only why for it to happen is by pressuring the lawmakers to take a yes or no decision.
I think we should all request our employers to call the lawmakers, individual calls will help but we need to take it to the next level as the window is very short.
Ok it too late for the letters..we need to focus on the HR bills by Resp Sen Lofgren..we have a narrow window here.. and bi partisan support..we can send her flowers and request the Senator to take this up seriously..also we can send the flowers to the co-sponsors..at thier local offices instead of DC ..since DC office is closed now..

I know the rules of car buying and hence mentioned the word hypothetical - however, as I said earlier, I agree with your basic principle that we are liable for whatever we signed up for and if you look at my first post on this thread that is exactly what I suggested to punjabi77 i.e. Is renting an option?
If we strictly go by the purpose of this thread - yes, we are in agreement that punjabi77 should look at alternative ways of paying off his mortgage or just simply sell his asset with a ~20k loss.

I called vonage cs too...she confirmed the 5k limit exists for residential vonage world program. Minutes are counted only against outgoing calls. 5000 min is approximately ~ 2.6 hours per day for 31 days which I think should be sufficient, unless you are running some kind of a business from home.
In a case the 5k limit is nearing or has exceeded, vonage will send an email alerting us to this, at which point we will need to talk to their usage management team. This team will evaluate the situation for us - mostly that translates to this - if we exceed this again, they may make us get the next higher premium plan.

I have received an RFE on my H1-extension too. USCIS wanted sealed copy of my trnascript from my foreing university.
To answer the original poster. You can file your I-485 since your extension is pending and you do have a receipt fro USCIS.

current Visa bullettin does not give any info about next months...its talks about other workers..can you point to the sentence where it says it going to be april01-nov 01??..

The current visa bulletin says EB3 PDs may go back to the level that was in June 08 visa bulletin or worser. So it is very likely that EB3 will be anywhere between Apr 2001 to Nov 2001. Personally I would be happy if it remained at least beyond May 2001.
I dont see EB3 moving to 2002 unless USCIS wants to agressively move it forward, so that they can continue their unfair trend of procesing some out of order low hanging fruit cases in EB3 category, just because they are sitting on the top of their applications pile, even if they had much later PDs. Just like they are doing with EB2
What will unite people is to fight against the common pain point... *Unfair advantage given to out of order applicants* , whether it be EB2 or EB3, who are much later in the queue, but some how are on the top of application piles, and easily accessible to IOs- who are making DOS move the PDs, just so that they can clear of their tables by approving these cases, rather than trying to access applications in FIFO and follow a fair process.
The whole EB2-EB3 divide arose out of this unfair practice of USCIS. Which just on their whim move PDs forward , be it EB3 or EB2. It just happened, that EB2 date has been moved more aggressively, probably because there is less backlog there. But looking at all the EB2 people still waiting with 2003, 2004 PDs while 2006 are getting approvals, indicates that the real problem is USCIS not doing due diligence to identify the right cases to be processed next and get the exact count of such cases.
Just asking them to recapture visa numbers or cyring foul against wasted numbers etc will still not solve the problem unless we also FORCE them to follow FIFO and process cases FAIRLY. Otherwise USCIS will continue to use these recaptured visas and use them to approve FU***&G Out of Order cases and manipulate & play the system to achieve that by jumping around the PD up/down/'U' and what not, just so because it is *convenient* for them to do so.

My 485 was filled in June 2004 and I got married in Dec 2004. NOw I need to file I-485 for my wife. I have couple of questions.Any help is welcome.

2. What will happen if my GC is approved before we can file her papers?

Its good to hear from ppl that they got an Yellow form from Infopass etc... I have been to San Jose USCIS office multiple times asking for status.... I just don't receive any concrete information from them...Infact, they are even hesitant to create an SR to request an update...

Out of 40,040, 7% is allocated to china and an other 7% goes to India.

Our parents/relatives do not need a land phone in India. Send one VONAGE adaptor and they can call any number in India (long distance) and to USA and other 60 countries.
They can receive any calls in a Cell phone (prepaid) (in India - incoming is free).
So just take a broadband connection and Vonage. Bye BSNL/VSNL.........
Remember you are talking about INDIA which is not US. you need broadband connection and Electricity for VOIP and you know the availability and reliability of both in INDIA.

it looks like many folks got their approval one day after filing an SR - coincidence or a trigger? Is filing the SR somehow triggering the IOs to look at your file ?
However, many people who filed SR on the first working day of the month 08/02 were not approved the next day. Also, the many others who bombarded the USCIS with multiple requests/queries had to wait much longer or are still waiting.
It is almost like the IOs didn't like to be bothered on the first working day of this month (when the begin working on a fresh set of files) and also didn't like to be pushed too much.
Or is this all just a super coincidence for hundreds of people?

Getting any sort of data out of any of the immigration agencies is often frustrating. Especially something like how many eb2 I-140 did they accept, approve, deny... However, they do randomly throw number out and we can scavenge through them for `clues'. Here is one such link.
