Congrats!!!! Can you please tell the SR process? Do we have to tell the reason why we want SR on the case? If yes, what was your reason to open SR? Thanks!
You call the 1 800 number
Call 1 800 375 5283 and choose option 1 for English
* choose option 2 for checking case status
* Enter receipt number ........., select 1 to confirm the LIN number is correct
* It reads out the information which you can already see online
* It gives me few options to select now:- (To repeat press 1, to check another case press 2, to report a problem with this case press 3,
Press option 3 (problem with case) and then listen carefully to choose "case is outside processing time" and that should lead you to the representative
note down representative name and his id.
Tell him your information (A number, name, address, priority date etc when he asks for it) and tell him you are current and the case is outside processing time (it's too old case as the information online says they are processing 2009/2010 I 485 cases) and ask him the status of the case.
Ask him that you want to know about if the name check is completed, FBI background clearance passed etc and where is your case right now (assigned to any IO?)
This should trigger him to open an SR. Note down SR number.

I just called USCIS and they asked me to wait for 90 days. Our application was recd on July 23rd by B.GERKENSMEYER at NSC. She said that NSC has is processing Dec 21, 2006applications now. Couldn't give me an answer when I told her that USCIS website is showing dates of Aug 9th, 2007 as of today.

I got the SLUD on 9/3, 9/4, 9/7 2010. Showing the same message under review.waited all these days hoping for good news.No good news.called c/s(customer service),got response that they only "touched your file on 9/3,but don't have idea what IO did."

Can you please further explain how the visa flow will work if instead of horizontal flow it is made vertical flow... or you have some other interpretation?
Quite simply put EB3-ROW << EB2-I,C. So there is a faster chance of EB3-ROW going forward and being current before EB2-I becomes current. Therefore, with all other categories satisfied, it boils down to EB2-I/C and EB3-I/C. Thenceforth, as USCIS has indicated, the longest waiting PDs will be given the roll-over numbers, which is EB3-I.
So what will be the flow? I guess the following
EB1-> EB3-ROW (until current)
EB2-ROW -> EB2-I/C
Once Eb3-ROW becomes current
EB2-ROW -> EB2-I/C
EB3-ROW -> EB3-I/C
EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)
Please note, this is not going to be a quick fix for EB3-I. We are lowest on the totem pole, and barring legislative action, the only relief we can have is "earlier access" to numbers. one update: after a month the consulate asked me for a scaned copy of my I-797 aproval. sent it to them the that very day. called them up two days later to confirm if they recieved it and if the processing was done? the answer was "yes we recieved it" and "sir, it will take time" .. has anyone been requested for a scanned copy of their 797 by Chennai or other consulate?

if we pursue independent applications (so both spouses have the option to stop working if they want to); is this the way it works:
- file independent I-485s.
- whoever stops working changes status to H4 or F1 (depending on what they want to do)
- if one gets approved, the other withdraws the application made as a primary and files one as a dependent (since the other persons PD would be current at that point). Some lawyers say you can interfile the spouses I-140 at this stage, others say you cant.
Can you add a dependent after your 485 is approved?
Also, if I become a beneficiary on my wife's application, will I be able to maintain my H-1 status, and keep on renewing it?
My wife and I are now leaning towards independent filing, with no beneficiary for now.

I felt the same too since I am also in the middle of H-1B transfer and my PD is current. But I spoke to my new employer's attorney and he mentioned that they are two seperate processes and should not delay things. In most cases they are considered seperate. There is always a chance. But that is rare. Even I felt that using EAD would have been better but my EAD expired and the new company decided to do H1. So things started moving with H1 and my PD became current.
I saw LUD on my previous H1. So don't know what's going on.
Its just that i think if IO see's that there is an H1 transfer application pending, he may delay the AOS with the current sponsor. I am just mentally preparing myself, havent seen any change in online status.
Looking back, it might have been better to just go with EAD, that way USCIS wouldnt even know I am changing jobs then :D

Everyone knows that increasing green card numbers will be best solution. In that also if we ask too much we may not get anything. Double the number of annual Gc plus exclude dependents will be enough for reducing retrogession but that may not eliminate. But waiting period of 2 to 3 years can be reasonable for most people. I am sure one more chance will come for increasing H1b numbers. That time we can try for GC increase also.
But I am supporting the flower Campaign for protesting the VB mess up though it will not solve the problem

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????

Since the forecast is EB2-I will be current in a few years. Does that mean that someone with a PD of 2009 (EB2) would get the GC faster than someone with a PD of 2004 (EB3)?

You are correct, EB 3 I has less than 3k visas available. I have confirmed the number on Greg Siskinds blog. There is minor problem with BharatPremi's analysis. EB3 I's... we really need to do something about recapture. There will be no spillover available for EB3-I till 2012.

...is getting approved. My case is with an IO since Aug 3 and going by the trend, I should have received an update by now (within 2 weeks of getting assigned to the IO). Not sure whats going on :( This is the worst ever wait in my life. Wonder when its going to end???

Thanks for the compliments, I'm happy but we will be thrilled if apart from compliments, if you've said that you have just written to change.gov or to atleast one or two reps. Just spend a $10 on postage stamps. Dont think the reps dont read our letters.
