All,
With the current rate of outsourcing happening around in US and the rate of influx of temporary workers coming in on mostly L1 and may be few on H1 B Visas every year through the outsourcing companies , i am sceptical about the future of GC aspirants. With the way of GC processing happening which are caused by restrictions /policies of governing bodies and no sight of positive relief in near future i am little apprehensive about the future.
I feel that there might be no areas that are not impacted by Outsourcing boom . Most of the companies that i see and my friends work ,i see many of the operations are outsourced or planning in place to get outsourced.
with the current rate of outsourcing and subprime mess which may cause slow down in economy , i am not sure if there would be any positions to support our AOS , when our PD becomes current. Some times i think , the fight for GC is even worth it.

I am also July23 filer. Transfer TSC - CSC Finally NSC.
Today, I got FP for my wife for Dec-01 (Saturday:confused:).
Hoping, mine will also come soon.
One more thing...we called USCIS on 23rd Oct separately. They didn't open SR. My IO or Cust Rep said wait [more time-no timeline] and u will get ur FP notice. On the other hand my wife's IO or Cust. Rep said you get in two weeks. Now I see that her FP was issued on 5th Nov (2 weeks timeline).

Pls advice on the following-
1.I got my medicle done when the dates were current last time so the date on the medicle is old.now i have moved from canada to US.And i have to still fill the AR-11 form. in this case does the old medicle stands cancled or I can still go with that medicle and fill the AR- 11 now.
2.What is 9 digit A# in AR -11, my 1-94 has 11 didgit number and electronic format does not accept more than 10 digits.
3.The online AR-11 form also does not accept the canada address,

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
Every step in the GC process is traumatic. One step gives less trauma than the other. But there is no way anyone has got a GC without agony (unless you had an easy way out).

and how are you so sure that all EADs that will be entering the market are freshers. My wife (now on H4) already has 4 years exp in UK (psychology) before coming to US. I know a lot of H4s who have 7+ yrs exp (may not be very recent as they couldn't work on H4). So most of them may not be freshers but yes, competition is always healthy.

I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.

usage of spill over must be based on demand estimates and cannot be an exact science.
removal of ROW spill-over must be in anticipation of the dam burst expected when the BECS finally cross pass the april 30 PDs ( ROW being a big majority of these applications).
We need to look at what the BECs are doing and where they are wrt apr 2001 apps. I believe they are almost past it or in the thick of it. there would be a 3-4 month lag since a lot of these guys are going through recruitment.
That will tell us whether we are seeing the worst or if it can get worse.

I think most of EB3I and EB2I are missing one point.
EB3I didn't loose anything by the change in spillover policy few years back.
It is EB3-world who lost. Obviously EB2I and EB2C was on the gainers side.
EarlierSpillover EB1row->EB2row->EB3row->EB1I/C->EB2I/C->EB3I/C
CurrentSpillover EB1row->EB1I/C->EB2row->EB2I/C->EB3row->EB3I/C
(or to be more precise, it is currently EB1->EB2->EB3 since spill overs are not considering country based limitations)
Either way EB3I was last in the que. So nothing changed for EB3I or EB3C.
EB2I or EB2C on the other hand moved ahead of EB3row, that is very noticeable.
EB1I/C also moved ahead of EB2row, by this is not that noticeable, since all these categories were close to "current" either way.
In summary, you change the spillover whatever way.... EB3I is always going to be at the end of the line, least benefiting from any spill over.
