The law unambiguously states that for employment based categories - EB1 spillover should first go to EB2 and whatever is not required by both EB1 and EB2 will spillover to EB3. If the USCIS has been doing something different previously they were actually not following the letter of the law.
Here are the relevant sections of the INA which unambiguosly states the above.
Here is what Section 203 of the Immigration and Nationality Act states -
EB1 -
(1) Priority workers. - Visas shall first be made available in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (4) and (5),...............
EB2 -
(2) Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability. -
(A) In general. - Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1) ...............

Thanks for posting this I was searching for some advise on this aspect ....
I have one questions based on this comment :
If a person uses one of his I-140s and the adjustment is for some
reason denied, it appears that there is no reason why they can not then
re-apply for adjustment using the other approved I-140 providing all the
requirements are met under the petition.
So lets say Husbands 485 gets deined for some reason and the wife has an approved I 140 but her PD is not current any more, can the substiution still happen or are the couple doomed?

I am happy for you. The process indeed takes an emotional toll on us. Thanks for the heads up about the type of mail. I will be careful to watch out for "credit card offer" type snail mails.
After you get the CPO, the whole process seems to be automated. I think USCIS is using some workflow Product.
I guess in 80 to 90% of the cases , after CPO you shud expect your card in 11 days.

Yes, the old system will be restored. Please note that this is the only sure fire way of EB3-I going forward. There is some comments that EB3-I can really only benefit if EB2-I goes current with the current horizontal spill over rules. Such statements are clearly misleading. Eb3-I will not directly be impacted by EB2-I being current. It just allows EB3 to get a lot of numbers which will first be used by EB3-ROW before spilling over into EB3-I.
With this change, we get EB3ROW move ahead faster, it probably would have been C had the rules been followed, and EB3 would have started moving ahead.
The only way for EB3 to move ahead is for EB3-ROW to become current, nothing else will help EB3 beyond the visa recapture (which is iffy at best). If we get USCIS to follow rules, this happens sooner, and EB3-I starts to move sooner. If not, EB3-I shall wait for a long time.

So, I guess it all boils down to what is the legal status of somebody who has 485 pending, EAD, and AP? At that point you are no longer on H-1B. Is this status covered in the definition of a "U.S. worker"? ... Anybody?
As per Ron Gotcher, "Anyone with I-140 portability and an EAD is a "US worker" as that term is defined by the Department of Labor.".

Hi pakrish, similar situation here. My wife's gc has the gender mentioned incorrectly. From what I've researched, we need to file for I-90 and choose option D - correction in green card. There are no fees required as it's a USCIS mistake but the original card needs to be sent with the form.

People go by "how the wind flows" - when they just see a few of us stressing out they think they must not do anything - simply because they think wind is not blowing. Unless people believe in themselves and have the capabilities to make right choices and independent decisions, they will always be influenced by "negative flow". This is something we have always been facing in the community.
Every member and a guest must take these efforts seriously. Make your own wise judgement and not get influenced by negative flow. The negative community can pull you down big time, they have the capacity to destroy themselves and the entire community. Laziness seems to be the major cause for the negative energy and it will be interesting if people have any other excuses

1. Setting up banners will not only attract new members, but will make these EAD holders think from a rational perspective.
2.Also IV administration should send out a personal email to all it members, informing them about the importance of coming together, this way the EAD members who have stopped coming to IV will get the message.
3. We should contact the Indian newspaper editors, to print about our rally on March1st 2009, I believe more awareness we spread a better result we get.

I am not on L1, neither do I work in the kind of an assignment which will come under the radar due to this - but have many friends on L1. Hence I think I may have a slightly more balanced and perhaps somewhat sobering POV on this.
Since I have many friends on L1 - I know pretty well how they are abused by their employers. Just the fact that you cant quit the employer enables some forms of abuse so subtle that they will not stand in any court of law. So I hope for the sake of people on L1, and to uphold the rule of law - that this abuse stops. If it does - their employers would be forced to bring them in H1 - which is far less prone to abuse due to the portability.
However, the current "run to the DOL/ICE" approach that you guys are taking may have repurcussions well beyond you had bargained for. Think of it from the POV of a client manager (lets take the example of, say, a goldman manager). He has his hands full of sucking up to his boss, playing the internal politics and in his spare time doing some work. 99% of them (even those who actually immigrated themselves) have no appetite to get into the details of immigration law. So, as soon as there is a backlash on this - their immediate response would be to take the safest route out and require Citizenship/GC for all positions.
As soon as that wave starts - many of us are going to get burnt. Many of us who have EAD, including yours truely, would probably be able to sneak through without too much of an issue (since it is illegal to discriminate against EADs) - however, many others who are not so fortunate would probably not fare so well. Most probably what will happen is that as soon as a recruiter sees brown skin and hears some trace of an accent - alerm bells would go off in the mind to check if this guy is GC holder or a citizen.
The enabler of the L1 abuse is the non-portability of these visas. We cant do much about that in the current environment. But going all gung ho in terms of enforcement right now -when there is a recession in full swing - may not be in the best interest of any of us.

I have been pretty impressed with both call quality & customer service for ALLVOI. But I have not used Vonage, so cannot compare the two.
I went from spending $130-140 a month on India calls + phone line to $ 14.99. It couldn't get any better :)
