Today is my day. After 13 years into this country, finally I am green. I tried SR, Senator help, infopass without much help. 2 days ago when called, Texas POJ, one nice IO told me case is not yet assigned to officer, will send email, looks like worked this time. BUT this could be just incidental. Thanks IV. I have updated the profile. I only received the email, no text message.

OK....wait till next week for an outright refusal on EAD.
once that happens.....explore the option to file suit......
they first stated that they had instructions from their legal team that they have too much hassle with EADs causing problems, so they dont hire ppl with outside EAD. When I asked them to reconsider they said I dont know for sure, lets see what the legal team says.
It seem to me that this hr person did not make up the refusal on their own, but had previous precedents to go by or had been given explicit instructions.
My fear is that they will come back with a clearer explanation of why they cannot offer employment based on the EAD.
I am getting really really upset about this. If I had known about this EAD refusal thing I would not even have gotten out of H1 and would have continued to work...

Nothing will happen. The dates will be retrogresses on Monday. May be we will see 'U' in Visa Bulletin. The AILA will try to pursue DOS and USICS but they will politely say "sorry for the trouble" This will lead to the law suit. Some people will submit their resignation. In the next year you will see those at some higher post somewhere.

Went for first interview on 4th Jan. Got confirmation email today 15th Jan 2008. Got this email about an hour back.

1. Yellow pending letter
2. Passport
3. Envelope provided by the consulate (yellow, blue or green color)

Good luck to all those who are still awaiting confirmation. There is no use calling the VFS people, as they have no information. But it helps to know from other candidates on the time frame. So other people who have got the email, please post your experiences here for the benefit of all.

Based on what the person from Rep. Lofgren's office said "there would be vote in two months", does it mean really the Sept. 26 is not "the last" date for this congress? Would there be a lame duck session? And then of course for all the politicians lame duck session would be the best opportunity to tackle this.

I guess it is better to call republicans also who are opposing the bill and if possible give them our side of story too. There is no harm in doing that. We may be able to convince one or two members who are opposing it.

13 years since I landed in this country.....finally, I got the approval email 15 minutes back. I am not sure how to express my feelings (or lack thereof).
I want to thank the following guys from the botton of my heart.
1) KubMilegaGC - who gave me support in September or was around for sometime in October to check on my status
2) SeekerOfPeace, KewlChap and fatjoe - for all the valuable information they have provided. Thank you so much guys!!
I did the following:
1) Took around 10 Infopass appointments, with the last one being today morning at 9 AM PST. IO told me that my case was under review since July 2009.
2) Attorney reached out to AILA liaison
3) Sent DHS-7001 to CIS Ombudsman
4) Letter requesting USCIS secretary Napolatino to inquire about the delay in my case
5) Letter to first lady last weekend requesting to inquire about the delay in my case
6) Several inquiries were made by Congresswoman on my behalf
7) Inquiry was made on my behalf by the senator
8) Opened several SRs - I think around 6 or 7
As a result, I now have around 30 different responses from USCIS/DHS. Looking at each response, it makes me believe that they have not even cared to look at my case and have just pulled out a response from a standard set of responses.
I believe what really helped me is a phone call using the POJ method to TSC. I was fortunate to get a hold of a very nice and polite IO. IO walked me through the entire process and to my utter disbelief told me that my case was still sitting in the storage area and collecting dust (this was 2 weeks back). While I was on the phone, the IO sent a request to the folks in the storage area to pull my file out. Luckily for me, the file was in one of the storage areas in Texas itself. Once the file was at the Texas service center, it sat in the holding area for almost a week . It seems like the officer picked up my file sometime at the end of last week or earlier this morning.
Edit to the post: In hindsight, I think the delay in my case was because I had 4 I-140s (2 from RIR labor and 2 from PERM, one each for EB2 and EB3). I think whenever the IOs looked at my file, they thought that my case was not current. The IO I talked to specifically put in a note for the IO to look at the EB2 140 (June 2004) and not the EB3 I-140 (June 2004) or the I-140s that I have from July 2005. I dont know what to tell my attorney, not sure why they had to file 140s in EB3 for me.
Once again, thanks to everyone who has supported me to get through this painful process. Last 60 days (since September 1st) have been very painful for me.
Good luck to all EB2 who are still waiting and to all the EB3 folks, I hope you guys become current soon and get your GCs - I really really admire your patience.

The last month of the fiscal year is generally much much better. I doubt approvals for Oct will be anywhere near that.....especially since it is the first month and they will go slow...and November visa availability will be an eye opener.....not much hope....

Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.

Just talked to a recruiter from a software giant.
She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.
Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.
But she said once the fourth quarter passes, EAD hiring is not a problem.
Folks, we should not remain quiet about this. The regulations make it illegal for an employer to discriminate based on immigration status. We should politely and respectfully pursue the authorities regarding this matter.
I would encourage you to point out the USDOJ guidelines (posted earlier) to the "software giant" employer and also contact the OSC worker hotline.
Also, would it be wise for people to post name of the company who are known to have such policies? We got one - CapitalOne from earlier posts.

Wanted to update on my Infopass appointment, I have multiple 485's pending based on separate 140's(one approved and other pending) with different A#'s and at different service centers. So was bit concerned. The IO informed me that all my 485's and 140's have been consolidated and all applications are in the same file at one service center so nothing to worry about. She also told me to use the A# from the first 485 for future communications with CIS.
People who have multiple 485's pending, my word of advise is its not a problem. CIS takes care of it. And this is true even if you have different A#'s.

I has also gone for Infopass appointment this morning. Office told me that my case has been under review since July 20, 2009.
So there is a chance that the case was approved sometime in the last 2 hours, but I dont see any updates anywhere. As mentioned in my previous post, I will call TSC again at 4 PM. I hope I can hear the same words from some other officer or I get an email or see online updates before that.

Although the recent Reuters article mentions the flower campaign as an "Indian" effort, the flowers were sent by nationals of numerious countries to USCIS and this organization represents all nationals affected by visa backlogs and the visa bulletin fiasco. Immigration Voice recognizes and appreciates the contributions and participation of the members of all nationalities. This is not an "Indian" effort, its an effort supported and organized by all the legal skilled immigrants stuck in visa backlogs.

Isn't it part of her job? There is nothing like being servant. Moreover, it was just asked to rinse the bottle with hot water, to be sure it is hygenic, in a circumstances when baby was making tantrums. Another reason for asking was because bathrooms were full, otherwise there wouldn't have been a need. We have travelled many other airlines, and there was never an issue for such requests. Many airlines go extra mile to please you. It is what is called customer service.
I don't understand why is it hard or degrading? Maybe then they are not supposed to serve you a cool cup of water at your seat as well. Is that demeaning as well on part of her job?
no its not part of her job. I know a stewardess, and this exactly the part she dislikes about her job. people think its her job to attend to all little demands of the passengers.
She has two duties on the plane, in order:
- safety of the passengers. this is #1.(ensuring luggage is stowed, seatbeats are on, people are not wandering around the aisles; co-ordinate and help in case of emergencies)
- basic service (serve food, clear the trays, handle simple requests like juice/water, ice barfbags etc). This does not include cleaning out your babies bottles. Some airlines have stewardesses who would go out of their way (I have seen Singapore Airlines do this) but again, rinsing a baby's bottle is NOT part of her job. She can get you a bottle of hot water if you want and you can rinse it yourself either in the sink or into the barf-bag.
